By registering for, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, and by OLLO's Privacy Policy, which is incorporated by reference. If you do not agree, you must not register for or use the Platform.

- You must notify OLLO Support immediately of any unauthorized access.
- OLLO utilizes One-Time Password (OTP) verification to secure your profile.
- Profiling or sharing credentials will result in permanent account suspension.
You are responsible for all activity conducted through your account, whether or not authorized by you, except to the extent caused by OLLO's negligence.

Before accepting Rides, Drivers must complete OLLO's verification process, which may require submission of:
- National identity document
- Driving licence
- PSV permit/badge (where applicable)
- Vehicle insurance
- Vehicle inspection certificate
- Vehicle registration documents
- Any other document OLLO reasonably requires
You are responsible for ensuring that submitted documents are genuine, valid, not expired, accurately reflect your details, and belong to the registered Driver and vehicle.
Submitting false, altered, or expired documents is a material breach of these Terms and may result in immediate suspension or termination. OLLO may reject documents, request updates, or disable access where submitted documents do not meet required standards, without liability to the Driver for Rides missed as a result.
The "On Duty" feature is activated only after successful verification.
4. Nature of Relationship
The relationship between OLLO and the Driver is strictly that of an independent contractor, not an employee, partner, joint venture, or agent. OLLO operates a technology platform that connects independent Drivers with Passengers seeking transportation. OLLO is not a transportation carrier and does not provide transportation services directly.
You acknowledge and agree that:
- You act as an independent contractor and are not an employee, worker, partner, or agent of OLLO.
- You are free to determine your own working hours, accept or decline Ride requests, and use other platforms or provide services independently of OLLO.
- Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and OLLO.
- You are solely responsible for your own tax registration, filing, and payment obligations to the Kenya Revenue Authority and any other applicable authority, including turnover tax, income tax, and VAT where applicable.
- You are responsible for your own statutory contributions (e.g., NSSF, SHIF) where these apply to self-employed persons under Applicable Law.
5. Driver Responsibilities and Ride Services
As a Driver, you agree to:
- Accept and complete Rides responsibly and in good faith.
- Reach pickup locations within a reasonable timeframe.
- Provide safe, lawful, and professional transportation services.
- Comply with the Traffic Act, NTSA regulations, and all other Applicable Law.
- Treat Passengers with courtesy and respect, and not discriminate on any unlawful ground.
- Maintain the vehicle in a safe, clean, and roadworthy condition.
- Accept or decline Ride requests at your discretion.
Once a Ride is accepted, you are expected to complete it unless a valid safety, mechanical, or legal reason prevents completion, in which case you must notify OLLO and the Passenger promptly through the App.
6. Ride Completion and Payment Confirmation
On completing a Ride, you must confirm completion through the App and accurately record the payment status. You must only accept payment through methods supported by OLLO, currently including cash and M-Pesa or other supported digital payment methods.
For each Ride, the App provides a digital waybill showing the trip details (times, route, rate and Passenger name), your driver and vehicle details, and your vehicle insurance details. You must show the waybill when asked by the Passenger or by an authorised officer, such as the police or NTSA, and keep your driver, vehicle and insurance details in the App accurate so the waybill is correct.
Any payment discrepancy, disputed fare, or Ride-related issue must be reported to OLLO Support promptly and in any event within seven (7) days of the Ride.
7. Driver Earnings and Payments
Your earnings are calculated based on completed Rides, applicable fares, approved incentives, and referral earnings (if any), in accordance with OLLO's published payment structure, as may be updated from time to time with reasonable notice. OLLO may deduct applicable platform fees, commissions, taxes it is required by law to withhold, and any other agreed deductions before disbursing your earnings.
You are responsible for reviewing your earnings statements and must report any discrepancy to OLLO Support within thirty (30) days of the relevant statement, after which the statement is deemed accepted.
8. Driver Referral Program
OLLO may, at its discretion, offer a referral program allowing Drivers to invite eligible users to the Platform in exchange for referral earnings, subject to the specific program rules published in the App.
OLLO may withhold, suspend, or reclaim referral earnings, and suspend or remove referral benefits, where it reasonably believes the program has been misused or accessed fraudulently.
9. Notifications and Communication
By using the Platform, you consent to receive communications relating to Ride requests, Ride status, payments, document verification, account status, and service announcements, sent via App notification, your registered mobile number, or your registered email address.
10. Data Protection and Privacy
OLLO complies strictly with the Kenya Data Protection Act, 2019, and is registered with the Office of the Data Protection Commissioner (ODPC).
We collect personal identity data, real-time GPS location tracking, ride history, and transactional data. Location tracking is mandatory while the app is active to ensure safety and accurate fare estimation.
Data collection, storage, and cross-border transfers follow our detailed Privacy Policy.
In compliance with statutory laws, confirmed data breaches will be reported to the ODPC and affected users within 72 hours.
You have the rights available to you as a data subject under the Data Protection Act, 2019, including rights of access, correction, and objection, which you may exercise by contacting OLLO Support.

- Violate any provisions outlined in these Terms.
- Submit fraudulent, forged, or expired verification documentation.
- Engage in fraudulent trip creation or fare manipulation.
- Receive persistent low safety ratings or serious passenger complaints.

- Compromise passenger safety or repeatedly fail to meet service standards.
Where suspension or termination is not for the reasons above, OLLO will provide at least seven (7) days' notice.
You may close your account at any time by contacting OLLO Support, subject to settlement of any outstanding amounts owed to or by you.
13. Intellectual Property Rights
All intellectual property rights associated with the OLLO Driver Application belong exclusively to OLLO Drive Ltd.
- This includes software code, user interface designs, logos, graphics, databases, and trademarks.
- Drivers are granted a limited, non-exclusive, non-transferable, revocable license to use the app solely for its intended commercial purpose.
- You are strictly prohibited from copying, modifying, reverse-engineering, scraping, or redistributing the application infrastructure.
Violations will lead to immediate termination and legal action under the Kenya Copyright Board (KECOBO) framework.
14. Indemnity
You agree to indemnify and hold OLLO, its directors, officers, and employees harmless against any claim, loss, liability, fine, or expense (including reasonable legal costs) arising from your breach of these Terms, your negligence or unlawful conduct, or your provision of transportation services, except to the extent caused by OLLO's own negligence or willful default.
15. Limitation of Liability
OLLO operates strictly as a digital technology platform that facilitates connections between passengers and third-party transportation providers. OLLO is not liable for individual driver behavior, personal misconduct, injuries, or fatalities occurring outside or during platform trips. OLLO does not accept liability for traffic delays, road closures, or network downtime. OLLO is not responsible for vehicle wear and tear, mechanical breakdowns, or financial losses stemming from application misuse.
Total liability under any claim shall not exceed the total platform fees collected from the driver during the specific trip in dispute.
16. Force Majeure
Neither party is liable for delay or failure to perform an obligation under these Terms where such delay or failure results from circumstances beyond its reasonable control, including natural disaster, civil unrest, government action, or failure of telecommunications or power infrastructure.
17. Dispute Resolution and Governing Law
These Terms & Conditions are governed, interpreted, and construed entirely in accordance with the Laws of the Republic of Kenya.
Any dispute arising out of or in connection with this contract must first be filed with OLLO Support for internal review. If unresolved within thirty (30) days, the dispute shall be referred to mediation under the rules of the Nairobi Centre for International Arbitration (NCIA). If mediation fails, the matter shall be submitted to the exclusive jurisdiction of the competent courts of Kenya.
18. Amendments
OLLO reserves the right to modify these Terms & Conditions at any time to reflect changing economic, statutory, or operational landscapes. Significant changes will be broadcasted to users via:
- In-app notifications
- SMS alerts or WhatsApp Business communications
- Email updates to your registered address
Your continued use of the OLLO Driver Application following updates constitutes full binding acceptance of the revised Terms.
19. Severability
If any provision of these Terms is held invalid or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms, together with the Privacy Policy and any program-specific rules referenced in the App, constitute the entire agreement between you and OLLO regarding your use of the Platform, and supersede any prior agreement or understanding on the same subject.
