Introduction
These Terms & Conditions ("Terms") are a binding agreement between you ("User", "you") and OLLO Drive Ltd, a company incorporated in Kenya ("OLLO", "we", "our", "us"), governing your access to and use of the OLLO mobile application, including its features, services, content, and ride-related functionality (together, the "Platform"). OLLO is a technology platform that connects Users with independent driver partners to facilitate transportation services. OLLO does not itself provide transportation services. By downloading, registering, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, and by OLLO's Privacy Policy, which is incorporated by reference. If you do not agree, you must not register for or use the Platform.
1. Definitions
- Ride — means a transportation trip arranged through the Platform between a User and a Driver.
- Driver — means an independent driver partner registered and verified on the OLLO Driver Application.
- Applicable Law — means the laws of the Republic of Kenya and any regulations issued by the National Transport and Safety Authority (NTSA) or other competent regulator.
2. Acceptance of Terms
By creating an account or using OLLO services, you confirm that you have read and accepted these Terms, agree to comply with Applicable Law, and understand that OLLO provides a technology platform connecting you with independent Drivers who provide transportation services using their own approved vehicles.
3. Eligibility
To use the Platform, you must be at least 18 years old and have the legal capacity to enter into a binding agreement under Applicable Law. A parent or guardian may book a Ride on behalf of a minor using the parent or guardian's own account, provided the parent or guardian remains responsible for that minor while in transit. You must provide accurate information during registration and keep it updated.
4. User Account Registration
To access OLLO services, you must create an account by providing accurate information, including your full name, mobile number, email address (if applicable), and other required account information. You are responsible for keeping your account information accurate and updated, providing genuine information, and maintaining the security of your account. OLLO may restrict or suspend accounts containing inaccurate, incomplete, or fraudulent information.
5. Account Security and OTP Verification
OLLO uses secure authentication methods to protect user accounts. You must verify your mobile number through OTP, keep your OTP and login details confidential, not share account access with unauthorized persons, and notify OLLO immediately if you suspect unauthorized access to your account. You are responsible for activity conducted through your account, except to the extent caused by OLLO's negligence.
6. Ride Booking Services
OLLO enables you to request transportation services by providing pickup and destination locations, trip type, ride timing (Immediate Ride or Scheduled Ride), and vehicle preference (where available). Based on availability, OLLO may display available vehicles, driver details, estimated fare, and estimated arrival time. Ride availability depends on driver availability and operational conditions, and OLLO does not guarantee that a Ride request will be fulfilled.
7. Location Services
OLLO may request access to your device's location services to identify your pickup location, match you with nearby Drivers, provide route guidance, enable ride tracking, and support safety and service quality. Location data is processed in accordance with OLLO's Privacy Policy and used only to support the Platform's transportation services.
8. Fare Calculation
Ride fares may be calculated based on distance travelled, vehicle type, route and traffic conditions, and applicable fees or charges. Fares displayed before a Ride is confirmed are estimates and may vary based on actual trip conditions. The final fare will be reflected in your ride receipt within the App.
9. Ride Confirmation
After you submit a Ride request, OLLO will attempt to connect you with an available Driver and notify you of the ride status. Confirmation depends on Driver availability and prevailing service conditions, and is not guaranteed.
10. Payment Terms
You may pay for Rides by cash, paid directly to the Driver on completion of the Ride, or by supported digital payment methods available through the App. You agree to complete payment promptly for all completed Rides, provide accurate payment information, and report payment-related issues to OLLO Support within seven (7) days of the Ride.
11. User Responsibilities
You agree to provide accurate ride and account information, use OLLO services responsibly and lawfully, follow safety guidelines, treat Drivers with courtesy and respect, and refrain from abusive, fraudulent, or illegal activity or misuse of the Platform. You are responsible for your own conduct while using OLLO services and for any loss caused by your breach of these Terms.
12. Driver Interaction and Safety
After a Ride is confirmed, you may receive the Driver's name, vehicle information, and contact options, which you should use only for ride-related communication. You should verify ride details before starting the trip, follow safety instructions, and report any safety concern to OLLO Support immediately.
13. Ride Cancellation
You may cancel a Ride according to the cancellation options available in the App. A cancellation charge may apply where a Driver has accepted the Ride, has begun travelling to the pickup location, or where OLLO or the Driver has incurred operational costs as a result of the cancellation. Applicable cancellation charges will be displayed in the App before you confirm cancellation, and you may dispute a charge through OLLO Support within seven (7) days.
14. User Feedback and Ratings
You may provide ratings and feedback after completing a Ride. Feedback helps OLLO improve service quality, passenger experience, driver performance, and safety standards. You must ensure that any feedback you provide is genuine, accurate, and not defamatory or abusive.
15. Privacy and Data Protection
OLLO processes your personal data as a data controller in accordance with the Data Protection Act, 2019 (Kenya) and OLLO's Privacy Policy. Information collected may include personal details, contact information, location information, ride history, payment-related information, and device information, used to provide ride services, manage your account, ensure security, provide customer support, and improve the Platform. You have the rights available to you as a data subject under the Data Protection Act, 2019, including rights of access, correction, and objection, which you may exercise by contacting OLLO Support.
16. Account Deletion
You may request account deletion through the App's account settings (where available) or by contacting OLLO Support. OLLO will process deletion requests in accordance with Applicable Law. OLLO may retain certain information after deletion where necessary for legal compliance, security, fraud prevention, or financial record-keeping obligations.
17. Account Suspension and Termination
OLLO may suspend or terminate your account, with immediate effect where reasonably necessary for safety, fraud prevention, or legal compliance, where you violate these Terms, provide false information, engage in fraudulent activity, misuse OLLO services, or display abusive or harmful behaviour. Where suspension or termination is not for these reasons, OLLO will provide reasonable prior notice. You may request account closure at any time by contacting OLLO Support.
18. Platform Relationship
OLLO operates as a technology platform connecting Users with independent Drivers. OLLO provides the digital platform for Ride requests, facilitates communication between Users and Drivers, and supports ride management and service coordination. Transportation services are provided by independent Drivers, who are not employees or agents of OLLO.
19. Indemnity
You agree to indemnify and hold OLLO, its directors, officers, and employees harmless against any claim, loss, liability, or expense (including reasonable legal costs) arising from your breach of these Terms, your unlawful conduct, or your misuse of the Platform, except to the extent caused by OLLO's own negligence or willful default.
20. Limitation of Liability
OLLO provides a platform to facilitate transportation services and is not itself a transportation carrier. OLLO is not responsible for Driver conduct, user misconduct, traffic delays or other external circumstances, inaccurate information provided by a User, or events beyond OLLO's reasonable control. Users and Drivers remain responsible for their own actions and compliance with Applicable Law.
21. Force Majeure
Neither party is liable for delay or failure to perform an obligation under these Terms where such delay or failure results from circumstances beyond its reasonable control, including natural disaster, civil unrest, government action, or failure of telecommunications or power infrastructure.
22. Dispute Resolution and Governing Law
These Terms & Conditions are governed, interpreted, and construed entirely in accordance with the Laws of the Republic of Kenya. Any dispute arising out of or in connection with this contract must first be filed with OLLO Support for internal review. If unresolved within thirty (30) days, the dispute shall be referred to mediation under the rules of the Nairobi Centre for International Arbitration (NCIA). If mediation fails, the matter shall be submitted to the exclusive jurisdiction of the competent courts of Kenya.
23. Updates to These Terms
OLLO may update these Terms from time to time due to service improvements, legal requirements, or operational changes. Material updates will be communicated through App notification, email (where available), or other official channels, with reasonable advance notice where practicable. Continued use of OLLO after the effective date of an update constitutes acceptance of the revised Terms.
24. Severability
If any provision of these Terms is held invalid or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
25. Entire Agreement
These Terms, together with the Privacy Policy and any service-specific rules referenced in the App, constitute the entire agreement between you and OLLO regarding your use of the Platform, and supersede any prior agreement or understanding on the same subject.
